Daily accident benefits are reduced in the event of contributory negligence

A 44-year-old man suffered a traumatic brain injury in a bicycle accident with a car. As he was banned from driving at the time of the accident, the accident insurance company reduced the daily benefits by ten per cent due to gross negligence. The insurance company was proved right by the Federal Supreme Court: the cyclist was partly responsible for the accident, so the reduction was permissible. (Source: BGE 8C_9/2023 of 10 May 2023)
