Are employees' holiday credits statute-barred?

The Federal Supreme Court ruled some time ago that holidays are not forfeited if they are not taken by an employee in the year in which they are due. Unused holiday credits expire after 5 years. The vacation is due on the last day on which the remaining unused vacation days could still be taken during the current year of service and must be determined again for each year of service.

The employer must ensure that the employee takes his holidays and is responsible if the entitlement to non-take is made much later.
