What constitutes arbitrariness in the decisions of authorities or courts?

Arbitrariness in the assessment of evidence means that a court or authority reaches a conclusion that clearly does not correspond to the actual situation or is based on a clear error. However, it is not sufficient for the court to simply have a different opinion to the person concerned. Arbitrariness only exists if the decision is so nonsensical that it appears incomprehensible and cannot be justified on objective grounds.
