The will of the testator is decisive

Only the will of the testator is decisive as to whether a new will merely supplements or revokes an existing will. Anyone who insists on the earlier will bears the burden of proof.

 

A will is not per se valid for eternity, but can be freely revoked or amended at any time. Revocation can be accomplished by making a new will, by destroying it, or by making a later disposition. It is best for a testator to use the phrase, “I hereby revoke all wills made by me to date.”

 

Newer wills take precedence over older ones.
