Conclusion of employment contracts – better digital or handwritten?

Electronic signatures are increasingly being used in human resources. It is important to consider the different types of electronic signatures and the legal requirements. In principle, employment contracts are form-free and can be concluded in various ways, e.g. by email or with electronic signatures.
Exceptions: Apprenticeship contracts must be in writing and agreements on overtime pay and certain agreements under collective employment contracts or standard employment contracts may require written form.
Conclusion: Most employment contracts do not require a specific form, but there are important exceptions. Electronic signatures are often sufficient, but the specific legal requirements must be observed.
