Can a bonus be reduced during maternity leave?
If the annual benefit is the basis for a bonus, this can be reduced during maternity leave, but not in the first eight weeks after the birth. An employee may legally return to work from the 9th week onwards. If she does not make use of this option, this is deemed to be voluntary absence and the employer is not obliged to continue to pay her salary or bonus. (Source: BGE 4A_59/2023 of 15.5.2024)
